An undertaking has been accepted from Seeley International Pty Ltd in response to alleged non-compliance with a GEMS level requirement.

During 2018, the GEMS Regulator purchased a Braemar air conditioner – model SDHF18C1S/SCHF18C3S for the purpose of check testing its compliance with the relevant GEMS determination. Testing of the model showed the annual energy efficiency ratio (AEER) for cooling at rated capacity declared by Seeley International Pty Ltd in their registration was not accurate.

In order to address this alleged non-compliance, Seeley International Pty Ltd has undertaken to:

  • compensate consumers who purchased this air conditioner for the excess energy usage
  • contact retailers and consumers of the model informing them of the consumer compensation offer
  • place a public notice on their website and Facebook page.

Seeley International Pty Ltd elected to cancel the registration covering the above model and BD18A/BC183A; BD18A/SCHF18C3S and SDHF18C1S/BC183A.  The GEMS Regulator has accepted this undertaking as an alternative to other enforcement action available to her for this alleged non-compliance. The GEMS Regulator will continue to monitor compliance with the GEMS Act and take swift action in response to any future instances of alleged non-compliance.
