Overview

The Compliance Monitoring Program outlines the Greenhouse and Energy Minimum Standards (GEMS) Regulator’s check testing and market surveillance focus, in accordance with the Greenhouse and Energy Minimum Standards Act 2012 (the Act) and associated regulations. The GEMS Regulator may adjust its check testing and market surveillance focus based on potential industry demands and market changes.

    Check Testing

    Check testing refers to principles and procedures the GEMS Regulator uses to verify (through laboratory testing), whether GEMS product models meet minimum energy performance standards (MEPS) and the energy efficiency claims of manufacturers and suppliers.

    The GEMS Regulator may check test any GEMS product category, with primary focus on:

    1. Refrigerated Cabinets
    2. Household Refrigerators and Freezers
    3. Televisions
    4. Air Conditioners (up to 65kW: including portable AC’s)
    5. Clothes Washers
    6. Clothes Dryers
    7. Computer Monitors
    8. External Power Supplies
    9. Electric Motors
    10. Swimming Pool Pumps
    11. Dishwashers
    12. Electric water heaters
    13. Gas water heaters
    Market Surveillance

    Market surveillance ensures that all GEMS product models offered for supply in-store and/or online meet their GEMS registration and labelling requirements.

    The GEMS Regulator will monitor all GEMS product types with particular interest in those that have been identified as potentially being of higher non-compliance risk, including but not limited to:

    1. Air conditioners (ensuring all have zoned ERL)
    2. Electric motors
    3. Televisions (non-major brands)
    4. Refrigerated Cabinets
    5. Swimming Pool Pumps.

    The GEMS Regulator focus will also include:

    • individual product online and third-party websites that allow multiple suppliers to offer GEMS products for sale or supply in Australia; and
    • new entrants to the market to ensure they understand their obligations under the GEMS Act.

    GEMS Inspectors ensure:

    • regulated products are registered correctly
    • where applicable, the Energy Rating Labels (ERL) and Zoned Energy Rating Labels (ZERL) are clearly displayed and not missing, obscured in any way or damaged.
