Delegation of GEMS Regulator functions to Energy Safe Victoria

The Greenhouse and Energy Minimum Standards (GEMS) Regulator supports the delivery of energy efficiency polices. They are responsible for regulating products to ensure they meet:

  • minimum energy performance standards
  • labelling requirements including the Energy Rating Label.

The GEMS Regulator can delegate statutory functions to Commonwealth, state and territory agencies. This is a power from the Greenhouse and Energy Minimum Standards Act 2012 (the Act). These delegations assist the GEMS Regulator to carry out their responsibilities.

Functions have been delegated to Energy Safe Victoria (ESV) over several years. In late 2024, we became aware of an administrative error. A historical delegation arrangement with ESV had been inadvertently revoked. When the error was identified, a valid delegation from the GEMS Regulator to ESV was already in place.

Affected stakeholders have been notified. This information has been made public to maintain trust in the GEMS Regulator’s role to administer the Act.

Important to note:

  • Statutory remedies are in place to account for this administrative error. This includes a new delegation for the affected period.
  • GEMS Regulator functions continue as usual. Safeguards are in place to prevent similar issues in the future.
  • There are no impacts to GEMS products during the affected period.
  • The safety and regulatory standards of GEMS products were not compromised.
  • Consumers can continue to rely on GEMS information. This includes the Energy Rating Label to inform their purchasing decisions.
